Fourth temple site lawsuit filed Friday

Then there were four--lawsuits that is.
Preserve Our Cody Neighborhoods filed a second petition for review in District Court Friday.
Currently the Church of Jesus Christ of Latter-day Saints and POCN each have two suits against the City of Cody Planning, Zoning and Adjustment Board involving the dispute over the proposed site for the LDS temple in Cody.
The earlier petition for review by POCN challenged the conditional use permit for the temple.
The second petition filed last week asserts the site plan as approved by the city through P&Z was unlawful because the site plan “purports to illegally authorize: a) incorrect specifications to building height allowances/limitations; b) incorrect enforcement or lack of proper enforcement of scale or density compatibility mandates; c) incorrect and/or inadequate protections to persons, property and the general welfare by reasons of excessive production of traffic, glare, light and damage to the view shed; and, d) risks to public health welfare and safety.”
The petition also claims the site plan is “arbitrary, capricious and an abuse of discretion,” and states the “Site Plan is contrary to controlling law and “the Site Plan is the product of a tainted administrative decision-making process involving one or more City personnel who acted with a known conflict of interest and/or bias in a manner that unduly prejudiced the administrative decision-making process and, thereby, denied the Petitioners due process of law.”
The two suits filed by the LDS church against the city’s P&Z board ask the District Court to determine whether the site for the proposed temple has already been approved by the P&Z board.
Cody Mayor Matt Hall in an opinion piece in the Tuesday Cody Enterprise said, “We recognize that ultimate decisions of this board (P&Z) and all other boards must rest with the elected officials. Your mayor and council will ensure this happens.”
Hall also said, “It has been apparent the City of Cody will likely become a party to litigation regardless of the decision rendered by the mayor and council.
The city is asking for some time to “decrease the hostility and assist the parties in reaching a compromise, if any can be reached,” Hall said.

The Church reasons that sooner or later the town of Cody will have to capitulate due to the cost of litigation. They will teach those heathen rubes to bow down before the might of Kirton McConkie. The Church might be hated by the Cody residents, but by God, they will fear their litigious power!!!

Making Friends LDS style
If the temple gets built, the Cody folks could always do what the folks of Highland Ca. did.
Here is the story. My father was a stake athletic director for years, and in the late 70's the Highland stake center had a huge lot behind the stake center. My father drew up plans, got permits and actually got some monies from the stake, and we, the different PH quorums in the stake, built a ballpark..." field of dreams" style. With bleachers, restrooms and even a snack bar. Above the snack bar was a booth with a PA for an announcer.
Long story short the ball field was surrounded on two or three sides by a residential neighborhood, and the folks in the neighborhood understandably did not want lights lighting up their backyards...the cheering, and a PA. They moaned to the then county/city, but lost.
So, to get even... at games a group of neighbors who lived directly behind the bleacher areas would blast hard rock, Led Zepplin was a favorite of the neighbors, and mine. I remember one game one neighbor had a canned laughing soundtrack and played it for entire 3 game block. But it only lasted a few seasons and it stopped. I guess the bright side of it all for the neighbors, there were no Sunday games.
in my opinion, in a time when the church is having trouble getting converts, it is not a good business move, even if it is within their legal rights, but like we (guilty) did not care then, they don't care now.
I just google earthed the ball field, they let it go to crap...you can see the outline where the bleacher where and the snack bar. Looks like they took down the lights also. My guess is they don't have enough people to form a league given the city and area is really going downhill. The closed chapel a few miles from here and sold the building a few years ago.

Members of the Church Finance Committee learned from the Draper Temple that there is money to be made from building luxury houses in a residential neighborhood and then tacking on a million or more dollars to the asking price for the convenience of being located near the temple.
