Is there room for a third category of participants? I mean those who:
(a) Think that the Philips case has some merit, was on balance worth bringing, and may make further progress.
(b) Are however perfectly prepared to find that the judge makes a decision that does not accord with (a), since that is very often just the way it goes.
(c) Find people who make very confident advance predictions in cases like this just a wee bit silly.
