Cakes: Thanks. I asked because I want you to check out page 13. The determination of Garcia’s ‘gang membership’ is linked to an unidentified other person saying that Garcia is in a gang. It’s acknowledged that this is hearsay but one judge has decided that this is ‘valid enough’. My point is that this went back and forth and likely wouldn’t hold up in court in most situations. Regardless, you’ve keyed into this because you seem to think that this allows for elimination of due process, perhaps, or that an unknown person alleging that someone else is ‘in a gang’ is the proper standard for determining any such thing, when this claim could be made by anyone about anyone.

It is linked to several things, and a confidential informant is one of them. It is not hearsay, it is admissible evidence by a reliable source. For all we know it was a undercover source.

And it also reads in a greater context... " Although the Court is reluctant to give evidentiary weight to the Respondent's clothing as an indication of gang affiliation, the fact that a "past, proven, and reliable source of information" verified the Respondent's gang membership, rank, and gang name is sufficient to support that the Respondent is a gang member, and the Respondent has failed to present evidence to rebut that assertion."

LOl....I never ever said this allows avoidance of due process in the context you are implying, I have said maybe a dozen of more times he was removed under AEA, and because he was deemed a MS-13 gang member. The two judges decision, the same verdict that protection by Garcia was filed against, stand from a past and proven reliable source.

CFR how you know it would not hold up in most court situations and how it negates the decision here.

Now he's asking for information regarding the details of a poster's private life? No one owes anyone personal details on this board but that which they elect to share and not in response to invasive prodding from any other poster.

What it means to me is that one point after another you have presented have failed, and it is sad that you just move on without admitting it and working through your fail, but just moving on to another poorly thought out fail. The most recent being your denial of corporations investing in American manufacturing, including big pharma, and Garcia "proven" to be a MS-13 gang member by at least two federal judges, and your complete inability to present, let alone expound on the democratic plan for America, and Trump's success in shutting down illegal immigration at the border, in which the previous administration said could not be done without a long winded bill.

There are plenty of things to find lame that Trump is doing, and especially saying.....the issue is, as Hound in focusing on, those with TDS can't give him credit where credit is due. And I'll add is that it is sad that you are rooting, whether you realize it or not, for Trump to fail at Americas expense.

All these points are what I consider, right or wrong, is you fail.

Markk, you are absolutely free to believe that someone claiming you’re a gang member is complete proof that you’re a gang member, even as you’ve had to admit that being a gang member isn’t against the law, anyway.

And you’re perfectly free to believe that billion-dollar corporations have made long-term infrastructure plans based solely on Donald Trump waffling for two weeks over tariffs, even when a company’s press release states otherwise.

Call that your victory! Not that either one has much to do with the present Administration’s desire to ditch due process and your constitutional rights when it’s convenient to them.

Hound can speak for themselves. I don’t think that they’ve stated any reasons to support Trump outside of a preoccupation with some odd sexual/gender hang ups. To each his/her own. : )
