Fact Check Debunks Rezko Charge

As for that claim about Rezko helping Obama buy his house, well, we've dealt with that one before. The gist of the story: In 2005, Barack and Michelle Obama found a house that they wanted to purchase. The property had been divided into two parcels, one containing a house and the other undeveloped land. The owner had listed the properties separately. After considerable haggling, the seller accepted the Obamas' third bid of $1.65 million for the parcel containing the house. Tony Rezko's wife, Rita, purchased the adjoining lot for $625,000.

When the Obamas wanted to increase the size of their yard, they approached the Rezkos about purchasing a strip of the adjacent parcel. Obama told the Sun-Times that a 10-foot strip of the 60-foot lot appraised for $40,000. The Obamas nevertheless paid Rita $104,500 (or 1/6 of the total purchase price of her lot) for the strip. In 2007, Rita sold the remaining lot for $575,000 (or roughly a $54,500 profit on the overall property).

McCain's ad, however, is worded in a way that could leave a false impression. It says Rezko "helped him buy his million-dollar mansion" by "purchasing part of the property he couldn't afford." That's true, but only because the seller wanted to sell the two parcels as a unit and the Obamas couldn't afford both. Rezko did not make a gift of any property to the Obamas. Furthermore, the fact that his wife sold her lot for more than she paid for it contradicts any suggestion that the Rezkos overpaid for their part of the deal as a way of getting the seller to lower the price to the Obamas for their part.

Obama was the first Chairman of the Board of the Chicago Annenberg Challenge, which was a Division, or Project, of the Annenberg Foundation which owns Fact Check.


I trust Fact Check. They have criticized Obama as well as McCain. Besides, their debunking consists of facts that could be shown to be false, if they were so.

Here’s what happened: In 2005, Barack Obama and his wife, Michelle, bid $1.65 million for a house on the south side of Chicago. According to newspaper reports, the owner was also trying to sell an undeveloped parcel of land adjacent to the property Obama was buying, and he wanted the sales of the two to close on the same day. Obama has said that he mentioned he was buying the house to a longtime political patron, Antoin (Tony) Rezko, a developer. Rezko’s wife wound up buying the lot adjacent to Obama’s. At the request of the Obamas, who were seeking a bit more space for their yard, she later sold them a 10-foot wide strip, or about one-sixth, of her land. The Obamas paid $104,500 for it, or about one-sixth of what Mrs. Rezko had paid for the entire property.

Obama doesn’t appear to have reaped any financial advantages from the transactions. The reason the deal has received a good bit of attention is that Tony Rezko – whose political contributions to Illinois’ former governor, Obama and others totaled in the hundreds of thousands of dollars – was known to be under federal investigation at the time the Obamas were purchasing their home. In 2006, Rezko was indicted in three federal cases: Two involved fraud schemes in which he allegedly demanded payments from firms wanting work from the enormous Illinois teachers’ pension fund and from those wanting favorable rulings from a state board that regulates the building of new hospital facilities. In the third, he was charged with fraudulently obtaining more than $10 million in loans for a pizza restaurant business; in December 2007, prosecutors added more fraud counts to that indictment.

Obama has a relationship with Rezko that dates back many years, but there’s no indication Obama did anything improper. Shortly after finishing law school, Obama, who had turned down a job offer from the developer, went to work at a law firm where he represented some community groups that partnered with Rezko to apply for housing rehabilitation loans. As a state legislator, he wrote letters to city and state officials in support of Rezko’s efforts to build apartments for the elderly with government money; the senator asserts that this was a project the community wanted. Obama got together with Rezko a couple of times a year, he has said.

Obama has donated campaign contributions from Rezko and his associates to charity, and he said in 2006, when the real estate transaction was reported by the press, that he made a “boneheaded” mistake by participating in the deal when it was known that Rezko was being investigated. “I regret it,” Obama said. “I’m going to make sure from this point on I don’t even come close to the line.”

I don't see anything in factcheck which debunks the story. Obama got a special deal from a man for whom he had done many favors.

For more than five weeks during the brutal winter of 1997, tenants shivered without heat in a government-subsidized apartment building on Chicago's South Side.

Obama has been friends with Rezko for 17 years. Rezko has been a political patron to Obama and many others, helping to raise millions of dollars for them through his own contributions and by hosting fund-raisers in his home.

Obama, who has worked as a lawyer and a legislator to improve living conditions for the poor, took campaign donations from Rezko even as Rezko's low-income housing empire was collapsing, leaving many African-American families in buildings riddled with problems -- including squalid living conditions, vacant apartments, lack of heat, squatters and drug dealers.

The building in Englewood was one of 30 Rezmar rehabbed in a series of troubled deals largely financed by taxpayers. Every project ran into financial difficulty. More than half went into foreclosure, a Chicago Sun-Times investigation has found.

"Their buildings were falling apart,'' said a former city official. "They just didn't pay attention to the condition of these buildings.''

Eleven of Rezko's buildings were in Obama's state Senate district.

Obama, now a U.S. senator running for president, has come under fire over his friendship with Rezko, who was charged last fall with demanding kickbacks on state business deals under Gov. Blagojevich.

Much of the criticism has centered on two real estate deals involving Obama's South Side mansion. In the first, Obama paid $300,000 less than the asking price for a doctor's home, while Rezko's wife paid the doctor full price for the vacant lot next door. Then -- a few months before Rezko was indicted -- Obama bought part of that lot from Rezko's wife.

But Obama's ties with Rezko go beyond those two real estate sales and the political support, the Sun-Times found. Obama was an attorney with a small Chicago law firm -- Davis Miner Barnhill & Galland -- that helped Rezmar get more than $43 million in government funding to rehab 15 of their 30 apartment buildings for the poor.

Just what legal work -- and how much -- Obama did on those deals is unknown. His campaign staff acknowledges he worked on some of them. But the Rezmar-related work amounted to just five hours over the six years it said Obama was affiliated with the law firm, the staff said in an e-mail in February.

Obama, however, was associated with the firm for more than nine years, his staff acknowledged Sunday in an e-mail response to questions submitted March 14 by the Sun-Times. They didn't say what deals he worked on -- or how much work he did.
"The senator, relatively inexperienced in this kind of work, was assigned to tasks appropriate for a junior lawyer,'' according to an e-mail from Obama spokesman Robert Gibbs. "These tasks would have included reviewing documents, collecting corporate organizational documents, and drafting corporate resolutions.''

In fact, Gibbs wrote, "Senator Obama does not remember having conversations with Tony Rezko about properties that he owned or any specific issues related to those properties.''
Rezko and Mahru had no construction experience when they created Rezmar in 1989 to rehabilitate apartments for the poor under the Daley administration. Between 1989 and 1998, Rezmar made deals to rehab 30 buildings, a total of 1,025 apartments. The last 15 buildings involved Davis Miner Barnhill & Galland during Obama's time with the firm.

Rezko and Mahru also managed the buildings, which were supposed to provide homes for poor people for 30 years. Every one of the projects ran into trouble:

• Seventeen buildings -- many beset with code violations, including a lack of heat -- ended up in foreclosure.

• Six buildings are currently boarded up.

• Hundreds of the apartments are vacant, in need of major repairs.

• Taxpayers have been stuck with millions in unpaid loans.

• At least a dozen times, the city of Chicago sued Rezmar for failure to heat buildings.

For five weeks, the Sun-Times sought to interview Obama about Rezko and the housing deals. His staff wanted written questions. It responded Sunday but left many questions unanswered. Other answers didn't directly address the question.
Among these: When did Obama learn of Rezmar's financial problems? "The senator had no special knowledge of any financial problems,'' Gibbs wrote.
Did the senator ever complain to anyone -- government officials, Rezmar or Rezko -- about the conditions of Rezmar's buildings? "Senator Obama did follow up on constituency complaints about housing as [a] matter of routine,'' Gibbs wrote.

Did the senator ever discuss Rezmar's financial problems with anyone at his law firm? "The firm advises us that it [is] unaware of any such conversations,'' Gibbs wrote.

Obama's friendship with Rezko began with a telephone call.

It was 17 years ago. Obama had just become the first black president of the Harvard Law Review. Newspapers wrote about him. One story caught the eye of David Brint, a vice president of Rezmar, a new company that had become the Daley administration's favored developer of low-income housing.

"I just cold-called him," Brint said in an interview.

Brint said he wanted to know if Obama would come work for Rezmar, developing housing for the poor -- something Obama had expressed interest in, according to the story Brint had read. Brint arranged for Obama to meet Rezko, but Obama didn't take the job.

Obama, who has a law degree from Harvard, subsequently returned to Chicago to lead a voter-registration drive in 1992.

The next year, Obama joined Davis Miner Barnhill & Galland, a 12-lawyer firm that specialized in helping develop low-income housing. The firm's top partner, Allison S. Davis, was, and is, a member of the Chicago Plan Commission, appointed by Mayor Daley. Davis was also a friend of Rezko. Davis and Rezko would eventually go into business together, developing homes.
Another firm partner, Judson Miner, ran the city Law Department under Mayor Harold Washington, one of Obama's political idols.

Asked what Rezko cases Obama worked on, Miner told the Sun-Times, "We'll put together a list of the cases he worked on involving Rezko/Rezmar in the next day or two.''

That was March 13. He never provided the information. [EMPHASIS MINE]

While at the law firm, Obama spent much of his time working on issues that would help improve conditions in poor neighborhoods, according to his first book, Dreams from My Father, published in 1996.

"In my legal practice, I work mostly with churches and community groups, men and women who quietly build grocery stores and health clinics in the inner city, and housing for the poor,'' Obama wrote in the book.

Three community groups represented by Davis Miner Barnhill & Galland were partners with Rezmar in the troubled housing deals.

Rezko offers Obama support

Obama had been at the firm for two years when he began his political career, running to replace state Sen. Alice Palmer.

Rezko became Obama's political patron. Obama got his first campaign contributions on July 31, 1995: $300 from a Loop lawyer, a $5,000 loan from a car dealer, and $2,000 from two food companies owned by Rezko.

Around that time, Rezmar began developing low-income apartments in partnerships with the Chicago Urban League and two other not-for-profit community groups, both founded and run by Bishop Arthur Brazier, pastor of the Apostolic Church of God and a powerful ally of the mayor -- the Woodlawn Preservation and Investment Corp., known as WPIC, and the Fund for Community Redevelopment and Revitalization.

All three community groups were clients of the Davis law firm. Davis himself was treasurer of WPIC when it went into business with Rezmar.

Why go into business with Rezmar? "We thought they were successful,'' Davis said, noting that little development was taking place in Woodlawn.

At the time, Rezmar had been in business for six years and had become one of City Hall's favored developers of low-income housing, managing 600 apartments in 15 buildings it rehabbed with government funding. Teaming now with community development groups, Rezmar rehabbed another 15 buildings, with 400 apartments, between 1995 and 1998. Each deal involved a mix of public and private financing -- loans from the city or state, federal low-income-housing tax credits and bank loans.

By the time Rezmar started working with those community groups, at least two of its earlier buildings were falling into disrepair -- including the Englewood apartment building at 7000 S. Sangamon where the tenants were without heat for five weeks.

The tenants there had no heat from Dec. 27, 1996, until at least Feb. 3, 1997, when the city of Chicago sued to turn the heat on. The case was settled later that month with a $100 fine.
It was during that time that the area's new state senator, Barack Obama, got a $1,000 campaign donation from Rezmar. The date: Jan. 14, 1997.

Obama works on Rezmar deals

Obama spent the next eight years serving in the Illinois Senate and continued to work for the Davis law firm.

Through its partnerships, Rezmar remained a client of the firm, according to ethics statements Obama filed while a state senator.

Davis said he didn't remember Obama working on the Rezmar projects.
"I don't recall Barack having any involvement in real estate transactions,'' Davis said. "Barack was a litigator. His area of focus was litigation, class-action suits.''

But Obama did legal work on real estate deals while at Davis' firm, according to biographical information he submitted to the Sun-Times in 1998. Obama specialized "in civil rights litigation, real estate financing, acquisition, construction and/or redevelopment of low-and moderate income housing,'' according to his "biographical sketch."

And he did legal work on Rezko's deals, according to an e-mail his presidential campaign staff sent the Sun-Times on Feb. 16, in response to earlier inquiries. The staff didn't specify which Rezmar projects Obama worked on, or his role. But it drew a distinction between working for Rezko and working on projects involving his company.

"Senator Obama did not directly represent Mr. Rezko or his firms. He did represent on a very limited basis ventures in which Mr. Rezko's entities participated along with others,'' according to the e-mail from Obama's staff.

Obama buys Rezko land

Over the years, Rezko, Mahru, their wives and businesses have given more than $50,000 to Obama's campaign funds, records show. And Rezko has helped raise millions more.
Rezko was among the people Obama appointed to serve on his U.S. Senate campaign finance committee, the Sun-Times reported in 2003. The committee raised more than $14 million, according to Federal Election Commission records, helping send Obama to Washington in 2004.

As a U.S. senator, Obama grew closer to Rezko.

Two years ago, Obama bought a mansion on the South Side, in the Kenwood neighborhood, from a doctor. On the same day, Rezko's wife, Rita Rezko, bought the vacant lot next door from the same seller. The doctor had listed the properties for sale together. He sold the house to Obama for $300,000 below the asking price. The doctor got his asking price on the lot from Rezko's wife.

Last year, Rita Rezko sold a strip of that vacant lot to Obama for $104,500 -- a deal Obama later apologized for, acknowledging that people might think he got a favor from Rezko. Obama called the episode "boneheaded'' and a "mistake.''

At the time Obama bought that strip of land, it had been reported that Rezko was under federal investigation for influence-peddling involving the administration of Blagojevich, whose campaign also received Rezko's financial support.
Rezko has since been indicted for allegedly demanding kickbacks from companies seeking state business under Blagojevich. Rezko's trial has been postponed while investigators sort through his finances.

'Disenchanted with Rezmar'

Rezmar's final low-income housing deals involving the Davis law firm went bad quickly.
Those deals were supposed to provide affordable housing for at least 25 years. But the first deal Rezmar struck with the Woodlawn Preservation and Investment Corp. collapsed in just six and a half years, when the state sued for foreclosure. WPIC and its sister agency, the Fund for Community Redevelopment and Revitalization, ultimately forced Rezmar to give up control of all 12 buildings they rehabbed together, citing financial troubles and deteriorating conditions of the buildings.

The state foreclosure suit came because Rezmar had stopped making monthly mortgage payments in March 2001 on a state loan to help turn an old nursing home into low-income apartments at 6140 S. Drexel, in Obama's state Senate district.

"WPIC became disenchanted with Rezmar and wanted to get rid of them,'' Brazier said. "They thought the buildings weren't being kept up properly. There were some financial problems.''
Rezmar and WPIC cut all ties last October, when the Chicago City Council agreed to let Rezmar out of a city loan. Rezmar transferred its interest to The Wolcott Group, a management company run by business partners of David Brint -- the man who had introduced Rezko to Obama.

Watchdog groups are questioning why it took Sen. Barack Obama more than a year to disclose additional details of his dealings with indicted fundraiser Antoin "Tony" Rezko.
While Rezko was known to be under federal investigation, Obama toured a Chicago-area home with him to get his opinion of the property, Obama's campaign revealed to Bloomberg News for a story published Monday. The politician later bought the home, with Rezko's help, who bought the adjoining lot in what was effectively a package deal.

Until then, Obama has professed trouble recalling such details during interviews with reporters.

Responding to questions about Rezko and the home sale last month, the Obama campaign repeatedly cited the candidate's on-the-record statements: "I don't recall exactly" conversations about the house with Rezko; "I am not clear" how Rezko decided to join in the purchase; and "I may have mentioned to him the name of a [developer] and he may at that point have contacted that person."

Pressed for more details, the campaign declined to provide any that were not then part of the public record.

The junior senator from Illinois has been answering questions on Rezko's involvement in the house purchase since news of it broke in 2006. In the 2005 deal, Obama purchased a house for $300,000 less than its owners were asking, and Rezko simultaneously bought the adjacent lot from the same seller at full price. Obama denies there was anything unusual about the price disparity. He says the price on the house was dropped because it had been on the market for some time but that the price for the adjacent land remained high because there was another offer.

Obama called it "bone-headed" to have engaged in financial dealings with the wealthy Chicago political operative, particularly as federal agents were reported to have been investigating Rezko for alleged corruption. He has also said he was "confident that everything was handled ethically and above board."

The new revelations appear to indicate Obama had involved Rezko at an earlier stage of his home buying process than was previously known, and left many wondering why he had not shared the information sooner.

"Why did they wait so long to disclose this?" asked Jay Stewart of the Illinois-based Better Government Association, which combats corruption, waste and fraud in government.
"If you run as an agent of change, a reformer...that's holding yourself to a pretty high standard," said Stewart. "But when you're laying out that kind of rhetoric...it makes sense for people to say, 'Let's look at what you've done. Let's see if your rhetoric matches with reality.'"

"Where is Sen. Obama getting his media advice?" wondered Cindy Canary, executive director for the Illinois Campaign for Political Reform.

"Is Obama following his instincts or the advice of a high-paid consultant?" she asked. "If it's a high-paid consulatant, maybe he should follow his own instincts... This is something that Sen. Obama should have put forward from the get-go."

Asked if there was a reason the campaign was mum on the Rezko home tour for more than a year after news of his involvement in Obama's home purchase broke, spokesman Bill Burton said, "No."

Where did Rezko's wife get the money to buy the property next to the Obama's new house? She got it from a shady billionaire

The Times of London follows the money in the journalistic tradition of Watergate and finds a strange connection between Tony Rezko, Barack Obama, and Nadhmi Auchi. The latter, one of Britain’s richest men, has a long history of shady financial dealings as well as numerous connections to Saddam Hussein, who he helped to power. According to the Times, Auchi sent a lot of money to Rezko just before his wife bought property adjacent to the Obamas in a land deal that has already raised a lot of eyebrows:

A British-Iraqi billionaire lent millions of dollars to Barack Obama’s fundraiser just weeks before an imprudent land deal that has returned to haunt the presidential contender, an investigation by The Times discloses.

The money transfer raises the question of whether funds from Nadhmi Auchi, one of Britain’s wealthiest men, helped Mr Obama buy his mock Georgian mansion in Chicago.

A company related to Mr Auchi, who has a conviction for corruption in France, registered the loan to Mr Obama’s bagman Antoin “Tony” Rezko on May 23 2005. Mr Auchi says the loan, through the Panamanian company Fintrade Services SA, was for $3.5 million.

Three weeks later, Mr Obama bought a house on the city’s South Side while Mr Rezko’s wife bought the garden plot next door from the same seller on the same day, June 15.

Why is this important to the land deal?

Mrs Rezko paid the asking price for the garden but the Obamas bought the house for $1.65 million, - $300,000 less than the asking price. The sellers deny they offered the Obamas a discount on the house because the garden had fetched full price from Mrs Rezko.

They took 15% less than the asking price? That’s a rather remarkable discount. And how exactly did the Rezkos afford to buy the adjacent plot? It cost $625,000, and they needed to make a $125,000 down payment on the land. Yet at the time, Tony Rezko had “no income, negative cash flow, no liquid assets, no unencumbered assets [and] is significantly in arrears on many of his obligations” — according to a sworn court statement a year later. His wife had an income of $37,000 and assets of around $35,000.

How could they qualify for a mortgage on the adjacent plot? Where did they get the money for the down payment? More importantly, why did Auchi lend so much money to Rezko, when Rezko had been in such financial straits? And why was Auchi so interested in Rezko in the first place?

Let’s take another look at Auchi:

Auchi’s brother was among the many Baathists killed by Saddam, but the execution did not inhibit Auchi’s business dealings with Iraq which, he says, didn’t stop until the Gulf war of 1991. His first coup in the West was to broker a deal to sell Italian frigates to the Iraqi Defence Ministry, for which he received $17m in commission. Italian investigators claimed that a Panamanian company owned by Auchi was used to funnel allegedly illegal payments. Auchi denied he had done anything wrong.

In the mid-1980s he got to know Pierfrancesco Pacini Battaglia, a man whose role in directing money to politicians led Italians to call him ‘the one below God’. Saddam Hussein had ordered the construction of a pipeline from Iraq to Saudi Arabia. Battaglia and Auchi secured the contract for a Franco-Italian consortium. In a statement to New York lawyers Battaglia alleged he knew how. ‘To acquire the contract it was necessary, as is usual, especially in Middle Eastern countries, to pay commission to characters close to the Iraqi government… In this case, the international intermediary who dealt with this matter was the Iraqi, Nadhmi Auchi.’ Auchi has denied any wrong-doing.

Nick Cohen suggests that Britain only extradited Auchi to France to face fraud charges in 2003 because our invasion of Iraq had ended his usefulness as an expert on the Hussein regime for MI-6. In any case, Auchi also allegedly had a hand in defrauding the UK’s National Health System after his fleecing of the French oil company Elf.

Rick Moran pines for the late Mike Royko, who would have known exactly what to do with these connections:

At this point, unless there is a deliberate, concerted effort by the large media outlets to allow this story to die once Rezko is convicted, I find it probable that other revelations are yet to come that will show Obama to be just another machine politician, skirting the edge of ethics and the law – perhaps even going over the line and engaging in criminal activities.

Obama is not the Agent of Change. He is a calculating politician who plays the game the same way politicians have been playing it for hundreds of years – receiving money in exchange for favors from government for his friends and cronies. And if Mike Royko were alive, one has to believe that despite agreeing with his politics, Royko would have been relentless in taking Obama down, hammering away in his own inimitable style at the influence selling, the sweetheart deals, the pay for favors, and all the rest of this sleazy mess.

No Royko today. But we have an army of bloggers who can push this story into the mainstream and force the media to expend the resources necessary to get to the bottom of the Rezko-Obama enterprise. True, like Whitewater it is a very complex story and there is very little ease in the telling. But given the stakes, an effort should be made nonetheless.

There seems to be a lot more to Rezko than just slumlording. When a figure like Auchi gives a low-rent figure like Rezko that kind of money, he’s not looking to expand tenement ownership.

Well, there you go. Obama's big sins. Shock and awe, Richard, shock and awe.

Just in case any of you all are delusional enough to think that the far right will actually be willing to work with Obama in the face of an economic crisis, Richard can set you straight. They'll go after him like they went after Clinton. No politician is a saint, obviously, but Clinton's problems were laughable compared to Bush's.
We hate to seem like we don’t trust every nut with a story, but there’s evidence we can point to, and dance while shouting taunting phrases.
