All Daniel Penny knew was that there was a black man in the carriage who was shouting and generally acting out. No other information was available to him.
On that basis, he put the guy in a tight choke hold for a period long enough that it led to the guy's death. As an ex-marine, he ought to have been aware of the risks of what he was doing. The law should punish people who act that way, which amounts to a single person imposing the death penalty for being a nuisance.
