You are speaking of a utopian view of the legal system. LDS, Inc. is not bound by that system in dealing with members. "By the power of the Holy Ghost ye may know the truth of all things".
No angel with a flaming sword or even a flaming marshmallow over a campfire threatened or warned The Brethrem about Nibley so he cannot have done anything wrong.
As for attacking or discussing works of those now dead. If it is true, go for it.

Before you criticize someone, walk a mile in their shoes. That way when you do criticize them you'll be a mile away and you'll have their shoes.

Actually, a member cannot be convicted in a Church court (Disciplinary Council) without hard evidence. In other words, a member cannot be convicted by "revelation". A bishop cannot bar someone from taking the sacrament, for example, unless he has evidence of transgression in the form of witnesses, or a personal confession. In a high council court half of the councilors speak in defence of the accused.

Speaking ill of Nibley, Peterson and anyone else, or their speaking ill of anyone is not something desirable. Reacting to Dr. Peterson as this thread has done is one thing but accusing anyone of a serious crime is another. Consider it to be an escalation in undesirableness.

I just want to go on record and make it clear that I don't believe Hugh Nibley molested or raped his daughter. The odds seem overwhelmingly against that. He is innocent until proven guilty and there is no one to prove him guilty other than one who has made accusations. I havn't even read those things! I'm ignorant! I was simply saying that I wouldn't be surprised to learn that he did. What my mother thinks is her own opinion and I simply brought it up to to throw some gasoline on the fire.
As far as I know Nibley was a wonderful man in his life but his Book of Abraham apololgetics sucks and wasn't presented in an honest format. It was slanted, biased, and completely designed to maintain faith in the system. To this day, how he walked over, or under, or around the name of the king and the name Shulem in Facsimile No. 3 is beyond me. That must have been something he had to wrestle with his entire career.

Being slanted, biased, and/or a liar doesn't make one a rapist. One is convicted based on the evidence. The evidence is missing in relation to Nibley. There are only allegations.
While LDS apologists may use the same argument for the allegations against Joseph Smith, the situations are quite different (even though the apologists like to use the same defense). There is evidence that supports the accusations of polyandry, public lying, coverup, etc.
The defense of Nibley succeeds due to lack of evidence. The defense of Joseph fails because of the wealth of evidence. Those who would defend Nibley have a solid case. Those who would defend Joseph have to continually contort the truth (not that this stops them, of course).

Ummm... that is not going to happen, at least not now, for lots of reasons. Daniel has too much riding on it.

Would you like to share what you know about DCP's intellectual sins? That would be good fodder for the board and everyone would love to read it. Do tell what you know or, what you think. I'm curious and would like you to enlighten me.
