This is a great point. However, wouldn't you think that if rosebud had something, she would have disclosed it by now? I mean, this is what is so frustrating and such a waste of everyone's time. Rosebud, the cancerous pursuer keeps playing "I have secret evidence" and will not show the world the goods. And that makes me believe that we may have all of the relevant emails/texts.

Yeah. That’s what I found when I looked, but still doesn’t apply because only two employees. I’m confused now about who was on the board and for what period of time. John was executive director until he resigned, but it’s unclear what he had the authority to do. I think I misunderstood about whether Rosebud was on the board. I’m not sure how much it matters, but I think it would help to know who had the authority to hire and fire employees.Dr Exiled wrote: ↑Fri Apr 30, 2021 5:44 pmI looked at claims for wrongful termination for Utah this morning. In Utah, anyone can be fired for any reason except where prohibited by law. Utah has its own version of the federal anti-discrimination laws called the "Utah Antidiscrimination Act." Perhaps she might have had a claim under this act for harassment, but it was consensual. And the Open Stories Foundation would have pointed to how she was pursuing the relationship and JD was trying to break it off. She was the problem, creating an unwanted situation. Also, wasn't JD an employee at the time, too? He was the main person there but was still an employee, not management. In my experience, having litigated a few of these types of cases, her actions in pursuing the relationship would have killed any chances for success. She probably should have tried to be hired on as a contract employee and waited to see what Open Stories Foundation did, calling their bluff.Lem wrote: ↑Fri Apr 30, 2021 4:26 pm
I agree Rosebud, including all her permutations, are thoroughly unreliable. But the text messages documented in this thread apparently show a superior telling a subordinate he wants her 'gone' due to his romantic entanglement with her. That abuse of power is sexual harassment no matter how unsavory anyone finds the victim, and that conclusion does not depend in any way on her flaky recitations, but only on Dehlin's texts. Again, I think it's probably too late to do anything about it, including legally, because Open Stories Foundation is too small an outfit to be held responsible. Even though the victim is so easy to disparage, that doesn't mean we shouldn't look carefully at what Dehlin did.

What blows my mind here is that the texts provided to Mormonism Live make it look like Rosebud was trying to convince John to eject Joanna from Open Stories Foundation, while also trying to persuade him to give her administrator-level access to the Facebook group. I get the sense that her real play in August was to take control.

Maybe, but I’m really hesitant about trying to mind read these two. Both of these characters work awfully hard to create an image. I’m not sure I’d trust anything without a subpoena.Dr Exiled wrote: ↑Fri Apr 30, 2021 6:00 pmThis is a great point. Welcome to the rosebud rabbit hole. Anyway, I missed the employee requirement thinking that the state act would give more bite than the federal law. Anyway, Rosebud could have pursued common law wrongful termination claims but I think we would reach the same conclusion as rosebud was the pursuer, assuming of course we have all the relevant information.Res Ipsa wrote: ↑Fri Apr 30, 2021 6:01 pmYeah. I’d be surprised if John had the authority to fire a board member, which might explain all the machinations.Kishkumen wrote: ↑Fri Apr 30, 2021 6:03 pmWhat blows my mind here is that the texts provided to Mormonism Live make it look like Rosebud was trying to convince John to eject Joanna from Open Stories Foundation, while also trying to persuade him to give her administrator-level access to the Facebook group. Except that the situation did not require him to fire Joanna. Joanna had threatened to resign if John and Rosebud did not quit. Rosebud is telling John, "Let's call her bluff. She can't tell us what to do."

I got lucky because I looked at the statute to see if the limit was there. Otherwise, I’d have probably missed it too.
Does a common law wrongful termination in Utah have to be based on breach of contract or statute or violation of public policy? I’ve never gotten into the weeds in this area of law.
