In John's email to Rosebud he write:

I need you just to go. I need MS to contract. I need to have no more [REDACTED] drama. I need to have no more
conferences for a few years. I need to not have to manage you, or other things outside of the bare bones, selfsustaining
essentials (like MS and DanW's MM). I need things to be really, really simple, or I'll never finish my Ph.D.

And

I need us to downsize. Small footprint. I need simple, self sustaining, scalable projects (NOT like
conferences, or even MMH) -- and I need everything else to go dormant until I can resume management of things
after I graduate.

Even if Rosebud is given the option to reapply, same as John was, what is she going to be reapplying for? It appears her duties/job are going to be eliminated so what reasonable chance does she have that she is going to be re-hired?

I think this point is moot. JD had been doing MS for years at this point. Rosebud had been with Open Stories Foundation for less than a year. Both were asked to resign/terminated and given the opportunity to reapply as contractors. Let's assume that there was only one position available. It's no surprise the board rehired JD considering the work he was already providing. Open Stories Foundation was under no legal obligation to rehire her whatsoever.

Can I point out the obvious that the only way Rosebud could legitimately claim the offer to reapply was made by Open Stories Foundation in bad faith was to accept the terms and then for Open Stories Foundation to renege?

Absent that, her claim that that is what they “would” have done is as baseless as most of her other allegations.

That the board would have made a strictly business decision as opposed to a decision based on a full investigation of how their sexual relationship impacted the business is further evidence of harassment.

This thread has now been 125+ pages of me (extremely poorly), and now Lem (much more effectively) explaining multiple times what constituted sexual harassment by using clear evidence -- followed by a handful of posters continually responding with "Wait, explain with evidence again how it was sexual harassment??"

You mean, you have spent your time promoting Rosebud’s weaponization of Open Stories Foundation’s later policy regarding sexual harassment against JD for his actions in 2011-2012 in pursuing the revenge she promised in October of 2012, all because you hate John Dehlin for not living up to your vision of him. Some people buy narrow aspects of your technical argument.

It doesn't matter whether the offer was made in good faith or in bad faith. She chose to not resign, which is well within her rights. They chose to fire her.
