Even if Rosebud is given the option to reapply, same as John was, what is she going to be reapplying for? It appears her duties/job are going to be eliminated so what reasonable chance does she have that she is going to be re-hired?
I think this point is moot. JD had been doing MS for years at this point. Rosebud had been with Open Stories Foundation for less than a year. Both were asked to resign/terminated and given the opportunity to reapply as contractors. Let's assume that there was only one position available. It's no surprise the board rehired JD considering the work he was already providing. Open Stories Foundation was under no legal obligation to rehire her whatsoever.

Since you're such a fan of evidence, care to quote where Rosebud was explicitly offered her job back once she reapplied? I honestly am wondering if I missed that.

Can I point out the obvious that the only way Rosebud could legitimately claim the offer to reapply was made by Open Stories Foundation in bad faith was to accept the terms and then for Open Stories Foundation to renege?

Absent that, her claim that that is what they “would” have done is as baseless as most of her other allegations.

That the board would have made a strictly business decision as opposed to a decision based on a full investigation of how their sexual relationship impacted the business is further evidence of harassment.

It doesn't matter whether the offer was made in good faith or in bad faith. She chose to not resign, which is well within her rights. They chose to fire her.
