I see no issue with an individual in that situation doing so.
Your argument rests with the Trump Administration, which has now unilaterally defined all humans to be women. And if you acknowledge that there are millions of intersex individuals, then your disgust over anonymous progressives or Kenji-Brown Jackson not being willing to neatly wrap up the issue of their sex using stupid definitions seems … unwarranted.

How did you get the idea that any of us are reluctant to recognize that most intersex identify as either male or female? I certainly have no such reluctance! Of course we should recognize their identity if intersex persons identify as male or female! Nothing you have said diminishes the strength of our arguments!
And you still have not commented on what you think is right or wrong about the 2024 Democrat platform, which seems a perfectly fair and rational document to me.
